Welcome to Hill Wallet. These Terms of Service ("Terms") govern your access to and use of the hillwallet.com website and the resources and services made available through it (collectively, the "Services"), operated by Hill Wallet ("Hill Wallet," "we," "us," or "our"). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of the Services.

2. Nature of Services

Hill Wallet provides savings planning and tracking software that helps people save for the down payment, closing costs and move-in costs of a first home. Members enter a target home price, a down payment percentage, their own closing and move-in cost figures and their monthly expenses, and Hill Wallet lays out a plan with a base camp cash cushion, monthly savings milestones called switchbacks, and a projected summit date that updates as members log their own deposits. The Services are offered through our website and web app as a free plan (one climb with base camp, monthly switchbacks and a deposit log) and a paid subscription, Hill Wallet Plus, at $6 per month or $54 per year, which adds route comparisons, a shared climb with one co-buyer, pace check-ins and a printable savings history; Plus renews automatically until cancelled and can be cancelled at any time in account settings. Hill Wallet is a planning and tracking tool only: it does not connect to bank accounts, does not hold, move or invest money, and does not offer, arrange, compare or recommend loans or mortgages. The Services also include customer support and an optional text message program, Hill Wallet Climb Alerts, for account notifications.

Hill Wallet Plus renews automatically at $6 every month or $54 every year until you cancel. You can cancel any time in Settings, or by emailing support@hillwallet.com or calling (888) 338-9118. After you cancel, Plus stays active until the end of the period you already paid for, and your account then moves to the free plan with no further charges. Hill Wallet Climb Alerts sends account notifications only, such as deposit reminders, milestone and base camp notices, pace check-ins, sign in codes, billing notices and support replies. We never sell, rent or share your phone number for marketing.

3. Planning Tool Disclaimer

Hill Wallet is a savings planning and tracking tool. Summit dates, paces, route comparisons, base camp amounts and cost figures shown in the Services are projections calculated from the numbers you enter and the deposits you log. They are estimates, not promises, and actual home prices, closing costs and timelines will differ.

Hill Wallet is not a bank, lender, mortgage broker, real estate agent or financial advisor. We do not connect to your financial accounts, hold or move your money, check your credit, or offer, arrange, compare or recommend any loan or mortgage. Nothing in the Services is financial, legal, tax or lending advice, and using Hill Wallet does not mean you will qualify for any loan. The savings history you print is a record of deposits you logged, not a bank statement or proof of funds.

4. Eligibility and Acceptable Use

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement and that any information you provide is accurate and current.

You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use of, the Services by any third party. You agree not to attempt to gain unauthorized access to any portion of the Services, disrupt their operation, or use them to transmit harmful or unlawful content.

5. Intellectual Property

All content on the Services, including text, graphics, logos, icons, images, and the compilation thereof, is the property of Hill Wallet or its content suppliers and is protected by applicable intellectual property laws. The Hill Wallet name and logo are marks of the Company. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written permission.

6. Third-Party Content and Links

The Services may reference, summarize, or link to third-party content, products, and websites for convenience and informational purposes. Such references do not constitute endorsement, and we are not responsible for the accuracy, availability, or content of third-party materials. Your interactions with any third party are solely between you and that party.

7. SMS Messaging: Account Notifications

Hill Wallet operates an SMS messaging program, Climb Alerts, for account notifications only. We do not send advertising or promotional text messages. By enrolling in this program, you acknowledge and agree to the following terms:

Program Description: By opting in, you consent to receive recurring automated account notification text messages from Hill Wallet at the mobile number you provide. These include deposit reminders on the schedule you choose, milestone and emergency cushion notices, pace checks for Hill Wallet Plus accounts, sign in codes, billing and renewal notices, and replies to your support requests. Consent to receive text messages is not a condition of any purchase.

Message Frequency: Message frequency varies.

Message and Data Rates: Message and data rates may apply.

Opting Out and Help: You may opt out of the SMS program at any time by texting the keyword STOP to [INSERT SHORT CODE]. After you send STOP, we will send a one-time message confirming that you have been unsubscribed, and no further messages will be sent. For assistance, text the keyword HELP to [INSERT SHORT CODE], or contact us at support@hillwallet.com or (888) 338-9118.

Supported Carriers: Supported carriers include AT&T, T-Mobile, Metro PCS, Verizon Wireless, US Cellular, Google Voice, Cellular One, Cellcom, Cellular South, Interop, and Clearsky. Carriers are not liable for delayed or undelivered messages.

Privacy: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

8. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any information provided is complete, accurate, or current.

9. Limitation of Liability

To the fullest extent permitted by law, Hill Wallet and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your access to, use of, or inability to use the Services, or reliance on any information provided through them, even if advised of the possibility of such damages.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Oregon.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services or applicable law. The current version will always be posted on this page, and your continued use of the Services after any update constitutes acceptance of the revised Terms.
